Eighteen registered EU trademarks for iconic Russian vodka brands — including Stolichnaya, Moskovskaya, and Starka — were seized and auctioned by order of the Amsterdam District Court. The landmark sale, completed on 17 June 2024, represented the first successful forced sale of Russian state-owned assets in enforcement of the Arbitral Awards. Proceeds of €1.6 million were paid directly to the former Yukos shareholders.
The asset is registered to or beneficially controlled by FKP Soyuzplodoimport, which GML Limited contends is an emanation of the Russian state for the purposes of enforcement under the applicable international arbitration conventions. The Arbitral Awards, issued by the Permanent Court of Arbitration in July 2014 and affirmed by the Dutch Supreme Court in October 2025, provide the legal basis for all enforcement actions in this portfolio.
Enforcement proceedings in Netherlands are governed by the applicable domestic legislation on civil enforcement and state immunity, interpreted in light of the lex arbitri and the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. GML Limited maintains that the asset does not attract sovereign immunity, either because it is used for commercial purposes or because the Russian Federation has waived immunity by virtue of its submission to arbitration.
GML Limited's legal team identified Stolichnaya & Moskovskaya Vodka EU Trademarks as potentially subject to enforcement proceedings under the applicable international arbitration conventions. Preliminary ownership analysis confirmed the asset is registered to a Russian state entity.
In-house counsel commenced a detailed assessment of the enforceability of the asset in Netherlands, examining applicable state immunity doctrine, domestic enforcement legislation, and jurisdictional competence.
